Broadband Conditions :

Matters Beyond our Reasonable Control :

We shall not be liable for failure to do what we have promised to do under this Agreement if we are hindered from doing so by something outside our reasonable control. Matters outside our reasonable control will include but not be limited to lightning, flood or severe weather conditions, fire or explosion, civil disorder, terrorist activity, war, actions of local or national government or industrial disputes. Performance of the Telecommunications network or other operators, and Internet network, outside of our Equipment, is beyond our reasonable control.

Acceptable Usage Policy for Residential Broadband Service :

This Acceptable Usage Policy shall, wherever the context requires, apply to all Residential Broadband customers.

Introduction :

The following information sets out the terms under which Cablewatch Limited , herein referred to as Cablewatch Internet services are made available to existing Cablewatch customers. These terms and conditions are to be read in conjunction with your existing contract with Cablewatch Ltd.'Services' referred to in this agreement are to be understood to refer to internet and broadband services or any additional internet services that Cablewatch may provide in the future. 'Additional Services' as referred to in your contract are to be understood to encompass internet and broadband services.

Use of Services :

The User shall use the Service in compliance with all applicable Telecommunication regulations and other legislation.
The Service is provided for the Users own use and the User shall not resell or attempt to resell the Service in any manner. The Service shall not be shared in any manner with a third party.
Unless sold as a commercial service, the Service is not to be used for commercial purposes except within pre-agreed limits by Cablewatch Ltd. Commercial is to be understood as the running of a business.

The User agrees not to :

Cause annoyance, inconvenience, offence or needless anxiety to others by their use of Cablewatch services. Use the Service excessively. Excessive usage is that which exceeds 1 Gigabyte downstream usage per day. Excessive use will result in the suspension or termination of services. Notice shall be given before the suspension of services. Termination will result if services upon reinstatement are used excessively in the proscribed manner.
Transmit, download, distribute or host any materials which are subject to copyright legislation without the written permission of the copyright owner.
Transmit, download, distribute or host any materials which infringes the intellectual property rights of another person or organisation.
Transmit any computer viruses, worms or Trojan horses, or cause harm or damage to other computer systems. The User also agrees not to carry out unsolicited e-mailing or spamming.
Download or transmit offensive material including pornographic materials or materials that others may find offensive
Use the Service to transmit, host or create material which is defamatory.
Use the Service in a manner which infringes the privacy or proprietary rights of others or which causes disruption or denial of services to other Cablewatch customers

Liability :

Please consult your contract for terms regarding liability.

Termination of Service :

Cablewatch reserves the right to take such action as it deems appropriate against any user who violates any conditions of this Acceptable Usage Policy. In such Cases, all services may be limited, interrupted or terminated with or without notice to the customer.
